Terms of Service

Hawaiʻi Behavioral Companions LLC · Oʻahu, Hawaiʻi
Effective September 12, 2026

These terms govern your use of this website and the services offered by Hawaiʻi Behavioral Companions LLC (“HBC,” “we,” “us”). Booking a session also requires a separate signed Service Agreement. Where the two documents differ, your signed Service Agreement controls.

1. What we do — and what we do not do

HBC provides companion-based behavioral respite and safety shadowing: attentive, one-to-one, non-clinical support for a person with an intellectual or developmental disability so that their family can rest, and so that outings are safer and more successful.

We do not provide: nursing or any medical care; administration of medication; clinical RBT or ABA therapy, treatment plans, or data collection for a treatment program; diapering, toileting assistance, or clinical feeding; diagnosis or assessment of any kind; transportation of clients in a personal vehicle; or overnight supervision.

Clients who require toileting assistance or medical care must have a primary caregiver available for hand-offs. Nothing we do is a substitute for medical, psychological, or behavioral-health treatment.

The owner of HBC holds current Registered Behavior Technician (RBT) certification and current First Aid, CPR, and BLS certification. RBT certification is referenced to describe her training and experience. It does not mean HBC delivers clinical behavior-analytic services, which require BCBA supervision and are outside the scope of what we offer.

2. Eligibility

You must be at least 18 years old and the parent, legal guardian, or authorized representative of the person receiving support — or be that person yourself, acting on your own behalf. You agree that the information you give us is accurate and complete, particularly regarding allergies, medical conditions, elopement or water-attraction risk, and behaviors that affect safety. Omitting safety-relevant information puts the person we are supporting at risk and may result in a session ending immediately.

3. Booking, deposits, and payment

  • A booking is confirmed only when a signed Service Agreement and a 50% deposit have been received.
  • The remaining balance is due before the first session begins.
  • The Connection Profile intake form must be completed at least 48 hours before the first session.
  • Accepted payment methods are shown on your invoice. We do not store card numbers; payments are processed by a third-party processor.
  • All prices are in U.S. dollars and are subject to Hawaiʻi General Excise Tax, which may be passed through on your invoice.
  • Late return: if a hand-off runs past the scheduled end time, there is a 15-minute grace period, after which additional time is billed at $1 per minute. Please just text us — we would rather know than guess.

4. Cancellation

When you cancel What happens
More than 7 days before the session Full refund of the deposit
3–7 days before 50% of the deposit refunded
Less than 48 hours before Deposit is non-refundable
Flight cancellation, illness, or a family emergency We will work with you. Rescheduling in good faith is always the first option.

If we cancel for any reason — illness, emergency, or unsafe conditions — you receive a full refund of everything paid, with no exceptions and no argument.

5. Sessions can change shape

Weather, surf, crowds, closures, and the regulation of the person we are supporting all affect what a session actually looks like. We may adapt the plan, change location, shorten an activity, or move indoors in order to keep things safe and pleasant. Adapting a session in this way is part of the service and is not a failure to deliver it.

We may end a session early, with payment retained for the time and the reserved window, if continuing would be unsafe for the client, for us, or for the public, or if information material to safety was withheld from us.

6. Emergencies

In an emergency we will call 911 first, then you, then your designated emergency contact. You authorize us to seek emergency medical care for the person in our care if you cannot be reached immediately. You are responsible for the cost of emergency medical care.

7. Text messaging (SMS) terms

By providing your mobile number and opting in, you consent to receive text messages from Hawaiʻi Behavioral Companions LLC at that number.

Program description

HBC sends customer-care and transactional messages only: Connection Call and appointment confirmations and reminders, day-of session coordination and hand-off updates, invoice and deposit reminders, and replies to messages you send us. We do not send marketing or promotional messages.

How you opt in

  • By checking the optional, un-pre-checked SMS consent box on our Connection Profile intake form on this website;
  • By giving verbal consent during a Connection Call, which we confirm in writing; or
  • By texting our business number first.

Consent to receive text messages is not a condition of purchase or of receiving service.

Frequency and cost

  • Message frequency varies, and is concentrated around your scheduled session dates.
  • Message and data rates may apply.

How to stop, and how to get help

  • Reply STOP to any message to unsubscribe. You will receive one confirmation message and nothing after that.
  • Reply HELP for assistance, or contact info@HawaiiBehavioralCompanions.com or (808) 431-7775.
  • You may re-subscribe at any time by asking us.

Carriers and delivery

  • Carriers are not liable for delayed or undelivered messages.
  • Supported carriers may change without notice.
  • Text messaging is not a reliable channel for urgent or emergency matters. In an emergency, call 911 or call us at (808) 431-7775 — do not text.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. Full detail is in our Privacy Policy.

8. Photographs and media

Photographs are taken only as permitted by the media release you select in your Service Agreement, which offers three options: full consent, non-identifiable images only, or no photographs at all. Any of the three is fine and none affects your service. Galleries we share with you are private and password-protected. Consent is revocable in writing at any time and is honored retroactively.

9. Confidentiality

We hold information about you and the person we support in confidence, and disclose it only as described in our Privacy Policy — including our obligation as a mandated reporter of suspected abuse or neglect under Hawaiʻi law.

10. Website content

Content on this site is for general information. It is not medical, psychological, behavioral, or legal advice, and reading it does not create a professional relationship. Text, images, and the HBC name and logo belong to Hawaiʻi Behavioral Companions LLC and may not be reproduced commercially without written permission.

11. Assumption of risk and limitation of liability

Activities in Hawaiʻi carry inherent risks — ocean and water, sun and heat, uneven terrain, wildlife, and traffic among them. You acknowledge these risks. A signed liability waiver is required of every client, including recipients of free or reduced-cost Kōkua Hour service.

To the fullest extent Hawaiʻi law allows, HBC’s total liability arising out of the services is limited to the amount you paid for the service in question. We are not liable for indirect, incidental, or consequential damages. Nothing in these terms limits liability for gross negligence, willful misconduct, or anything else that cannot lawfully be limited.

12. Disputes and governing law

These terms are governed by the laws of the State of Hawaiʻi. Before any formal proceeding, both sides agree to try to resolve the matter directly, in writing, for 30 days. Any action that remains is brought in the state or federal courts located in Honolulu, Hawaiʻi.

13. Changes to these terms

We may update these terms; the effective date at the top will change. Material changes are posted here, and the terms in effect on the date you signed your Service Agreement govern that booking.
